European Commission publishes the EU Taxonomy Environmental Delegated Act and the Climate Delegated Act in the Official Journal

On 21 November 2023, the European Commission (EC) published both the European Union Taxonomy Environmental Delegated Act and the Climate Delegated Act (together the Delegated Acts) within the Official Journal of the European Union.

The Taxonomy Environmental Delegated Act provides technical screening criteria for determining whether an economic activity contributes substantially to the sustainable use and protection of: -

• water and marine resources;
• the transition to a circular economy;
• biodiversity and ecosystems; and
• pollution prevention and control.

The Climate Delegated Act also provides technical screening criteria for determining whether certain economic activities contribute substantially to climate change mitigation or climate change adaptation.

Following their publication, the Delegated Acts will come into force from 1 January 2024.
