UK Competitions and Markets Authority release consultation on draft guidance for the application of competition rules to environmental sustainability collaboration

On 28 February 2023, the UK Competitions and Market Authority (CMA) published a draft guidance (the Guidance) document for UK corporates wishing to collaborate on environmental sustainability with industry peers without fear of breaching existing competition laws.

Within the Guidance, the CMA reaffirmed their commitment to ensuring that businesses are not unnecessarily or erroneously deterred from lawfully collaborating on the environmental sustainability agenda. As part of the Guidance, the CMA confirms that it will not take enforcement action against environmental sustainability agreements, including climate change agreements, that clearly correspond to examples used in the Guidance and are consistent with the principles set out in the Guidance.

The Guidance is open for consultation and those wishing to respond to the consultation should do so before 11 April 2023.
