BaFin publishes Q&A document on SFDR

On 5 September 2022, the German Financial Supervisory Authority (BaFin) published a Q&A document to provide clarification on how market participants should interpret aspects of the Sustainable Finance Disclosure Regulation (SFDR).

The topics covered in the Q&A document include:-

• the application of SFDR to independent financial advisers domiciled in Germany, namely that regulations do not pertain to independent financial advisors;
• the interpretation of the term "promotion";
• the assessment of taxonomy-alignment for all investments underlying a financial product; and
• disclosures for pre-existing financial products.

BaFin intend to keep updating and expanding the list of questions covered in the Q&A document in the future.
