Commission Delegated Regulation setting out technical screening criteria under the Taxonomy Regulation published in Official Journal of the European Union

On 9 December 2021, Commission Delegated Regulation ((EU) 2021/2139)(the Delegated Regulation), made under Articles 10(3) and 11(3) of the Taxonomy Regulation, was published in the Official Journal of the European Union.

The Delegated Regulation sets out the technical screening criteria for determining the conditions which qualify whether an activity contributes substantially to climate change mitigation or adaptation objectives under the EU Taxonomy. It also sets out the technical screening criteria for determining whether that economic activity does no significant harm to any of the other environmental objectives.

The Delegated Regulation came into effect on 1 January 2022.
