European Commission adopts delegated regulations supplementing the Benchmark Regulation on sustainable finance issues

The European Commission has published provisional delegated regulations (the Delegated Regulations) supplementing Regulation (EU) 2016/1011 (the Benchmark Regulation) on sustainable finance issues.

The Benchmark Regulation introduced a common framework to ensure the accuracy and integrity of benchmarks referenced in financial instruments, financial contracts and/or investment funds in the European Union. The Delegated Regulations supplement the Benchmark Regulation, covering the following sustainable finance issues:

  • The explanation to be included in the benchmark statement of how environmental, social and governance (ESG) factors are reflected in each benchmark provided and published.
  • The minimum content with regards the explanation to be provided of how ESG factors are reflected in the benchmark methodology.
  • The minimum standards for EU climate transition benchmarks and EU Paris-aligned benchmarks.

  • Annexes to the Delegated Regulations have also been published.
