UK Government publishes draft Greenhouse Gas Emissions Trading Scheme Order 2020

The UK Government has published the draft Greenhouse Gas Emissions Trading Scheme Order 2020 (the Draft Order) setting out the framework for the UK Emissions Trading Scheme (UK ETS), accompanied by a draft explanatory memorandum. The new scheme will replace the EU Emissions Trading System (EU ETS), which the UK will stop participating in when the transition period ends on 31 December 2020.

The Draft Order covers key features of the UK ETS including:

  • the regulators for the UK ETS;
  • the monitoring, reporting and verification requirements; and
  • the cap on total emissions.
