In using the LMA website (the "Site") you accept and agree to be bound by the following terms and conditions (the "Conditions of Use").
Use of the Site
You are responsible for ensuring that you are in compliance with all laws, regulations and rules applicable to you in relation to your use of the Site.
The Site is not directed at any person in a jurisdiction where access to the Site is prohibited.
The Site is directed at professional investors in the loan markets and their advisors and its content may not be appropriate for use by other persons. The information in the Members Section is not generally available to non-professional investors.
3rd Party Websites
The LMA is not responsible for the operation or content of any external websites and a link from the Site to an external website is not an endorsement or recommendation.
Accuracy and Reliance
The information on the Site is not provided for any specific purpose and does not constitute legal, regulatory, financial or other professional advice, and should not be relied upon or treated as a substitute for specific advice relevant to particular circumstances. Whilst the LMA aims to keep information on the Site current, it is provided "as is" and there are no responsibilities or warranties (express or implied) as to the accuracy, quality or fitness for any particular purpose of the Site or its contents.
Persons using the Site acknowledge that, except where expressly varied or otherwise stated, all intellectual property rights associated with the Site (including without limitation all trade secrets and copyright) are vested with the Loan Market Association. If no specific restrictions are displayed, you may make hard copies of selected portions of the Site, provided copies are made for your personal use. In addition, subject to any specific restrictions, you may download or copy selected portions of the Site (but not the entire Site) for your legitimate and legal internal business purposes, provided any legal notices and disclaimers, copyright notices, trademark legends or other proprietary rights notices are not removed and any dissemination is provided to others free of charge. The Site and any information contained on the Site may not otherwise be republished, reproduced, distributed or transmitted to any other person or posted on any public website or alerter service. You shall not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit the Site, in whole or in part.
Limitations of Liability
To the extent permitted by applicable law, the LMA shall not be liable under any circumstances for any loss or damage of any kind including, without limitation, any direct, special, indirect or consequential loss or damage, arising out of or in connection with the access or use of the Site or from any reliance that may be placed by any person on any information of whatever nature which may be made available to that person as a result of using the Site.
Data privacy and confidentiality
Please ensure that the information you provide when registering with the Site is accurate and let us know (by email to mailto:email@example.com/) if it needs to be updated.
The LMA uses the information provided when registering with the Site, and the other information that it holds in relation to its members, to administer the Site and the LMA's membership, to send communications to its members and, generally, to promote the objectives of the LMA. Members will have access to this information in relation to their own nominated representatives, and the LMA will not disclose it outside the LMA except that the LMA may share it with other organisations with which it is working on joint projects, which may also use the information to contact the LMA's members. These arrangements may both on occasion involve transferring information overseas, including to countries which do not have data protection laws similar to that in the UK. Where the LMA shares information with other organisations for the purposes of joint projects, however, it will ensure that transferred information continues to be protected by appropriate safeguards.
Please ensure, when providing the LMA with information about your individual representatives, that those representatives are aware (i) of the matters set out above; and (ii) that they can contact the LMA (by email to mailto:firstname.lastname@example.org) if they want to have access to the information that the LMA holds about them, to correct any of that information or to request the LMA to cease using their contact details to send communications to them.
Unless information provided on the Site is in the public domain, you agree to keep confidential any information from the Site.
